Terms of Service
These terms govern your use of SendPilot, an email marketing and outreach platform operated by Elite Media 360 (“we”, “us”). By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you confirm you are authorised to do so.
Your account
You are responsible for the accuracy of your account details, for keeping your password secure, and for everything that happens under your account — including actions taken by team members you invite. Tell us promptly if you believe your account has been accessed without your permission.
You must be at least 16 years old and legally able to enter into a contract. One person or organisation per account; do not share login credentials outside your team.
Acceptable use
You agree not to use SendPilot to:
send unsolicited bulk email to purchased, scraped or rented lists; send content that is unlawful, deceptive, defamatory, obscene or infringing; impersonate another person or organisation, or forge headers to disguise the origin of a message; distribute malware or phishing content; interfere with or overload the platform or attempt to access another customer’s workspace; or resell the service without our written agreement.
You are responsible for the content of every message you send and for having a lawful basis to contact each recipient.
Anti-spam requirements
SendPilot is for permission-based email. You may only contact people who have consented, are existing customers, or are business contacts with a genuine and demonstrable reason to hear from you.
You must comply with the anti-spam laws that apply to you and to your recipients — these commonly include the CAN-SPAM Act, CASL, the UK PECR and the GDPR. In practice that means: identify yourself honestly, use accurate subject lines and headers, include a valid postal or contact address where required, keep the unsubscribe link intact on every message, and honour opt-outs promptly.
SendPilot adds a one-click unsubscribe link and a List-Unsubscribe header to outgoing campaigns and suppresses unsubscribes and bounces automatically. Removing, hiding or breaking these mechanisms is a breach of these terms. We may act on complaints from recipients or from mailbox providers.
Connected SMTP providers and third-party services
SendPilot sends through mailboxes and services you connect. Your use of those services remains subject to their own terms, and you are responsible for holding valid rights to use them. Some providers restrict cold outreach on their networks; complying with those restrictions is your responsibility.
We are not responsible for outages, rate limits, throttling, blocks or deliverability outcomes caused by a provider you connect. If you supply your own third-party API keys, charges from those providers are between you and them.
Your data and ours
You keep ownership of the contacts, content and other data you upload. You grant us only the permission needed to host and process it in order to run the service for you. Our handling of it is described in our Privacy Policy.
Intellectual property
SendPilot, its software, design and branding remain the property of Elite Media 360. These terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is active. You may not copy, reverse-engineer or create derivative works from the platform, or use our name or branding without permission.
Plans and billing
SendPilot offers a free tier and paid plans, which differ in the number of connected senders, contacts and monthly sends. Plan limits are enforced within the application.
Card payments are not currently enabled. Plans can be selected in the application, but no payment is taken and no charge is made at this time. If and when paid billing is switched on, we will publish the payment terms and give you notice before charging.
Paid plans are billed per period in advance — monthly or annually — in Indian Rupees, and processed by Cashfree Payments. We never see or store your card details.
Plans do not auto-renew. No mandate is placed on your card or bank account and nothing is charged automatically. When a paid period ends, the workspace returns to the Free plan; nothing is deleted, but Free plan limits apply from that point.

Suspension and termination
You may stop using SendPilot and close your workspace at any time. We may suspend or terminate an account that breaches these terms — particularly the anti-spam requirements — that generates sustained spam complaints or bounce rates that put other users or our infrastructure at risk, or where we are required to do so by law.
Where circumstances reasonably allow, we will warn you first and give you an opportunity to fix the problem. For serious or repeated breaches we may act immediately. On termination your right to use the service ends and your workspace data may be deleted after a reasonable period.
Service availability
We work to keep SendPilot available and reliable, but the service is provided on an “as is” and “as available” basis. We do not currently offer a contractual uptime guarantee or service level agreement. Maintenance, upgrades, third-party outages and factors outside our control may interrupt the service.
We may change or discontinue features. Where a change materially reduces functionality you rely on, we will give reasonable notice.
Disclaimers and liability
We do not warrant any particular deliverability, inbox placement, open rate, reply rate or business outcome. Email delivery depends on your sending practices, your domain reputation, your connected provider and the receiving mailbox provider — all of which are outside our control.
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for lost profits, revenue, goodwill or data. Nothing in these terms excludes liability that cannot lawfully be excluded.
Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost data or indirect losses. Nothing here limits liability that cannot be limited by law.
Changes to these terms
We may update these terms as the service develops. We will update the date at the top of this page, and for material changes we will notify you by email. Continuing to use SendPilot after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of India.
Disputes will be subject to the exclusive jurisdiction of the courts at Gautam Buddh Nagar, Uttar Pradesh.
